C.R.M. (NDPS)1871 of 2026
In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Gazole Police Station Case No.64 of 2026 dated 22.01.2026 under Sections 21(C)/25/27A/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985;
Gaurav Das Versus The State of West Bengal
Mr. Prajnadeepta Roy Ms. Sohini Kundu Mr. Debojyoti Goswami. …for the petitioner.
Mr. Krishnendu Bhattacharya Ms. Priti Kar Bagchi. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is similarly placed as the other accused person, namely, Vivek Kumar who has been granted bail in CRM(NDPS)1787 of 2026.
Learned advocate for the State opposes the prayer for bail but is unable to refute the contention that the petitioner and other accused are not on the same footing.
Having regard to the issue on which the other accused has been granted bail, petitioner is entitled to the same benefit. Accordingly, the petitioner, namely, Gaurav Das be released on bail on same terms and conditions as was granted in CRM(NDPS)1787 of 2026 upon Vivek Kumar.
