JUSTICE R DEVDAS) Learned counsel for the petitioner submits that the application filed by the petitioner before the Karnataka State Administrative Tribunal, Bengaluru, was disposed of on 17th October 2025 on the ground that the petitioner herein has not given sufficient breathing time to the respondents to consider his representation and therefore, - 3 - HC-KAR CNR: KAHC010745382025 NC: 2026:KHC:46553-DB WP No. 34828 of 2025 the application was held to be premature. However, the learned counsel for the petitioner submits while pointing out to Annexure-A9 that the 2nd respondent had rejected the candidature of the petitioner on the ground that the documents were verified and they are not complete and accordingly, the petitioner is not eligible for counselling. In that view of the matter, learned counsel submits that the Tribunal could not have rejected the application filed by the petitioner on the ground that the application is premature. 2. We accept the submission made by the learned counsel for the petitioner. 3. Accordingly, we proceed to allow the Writ Petition, while setting aside the impugned order passed by the Tribunal in Application No.4384/2025 dated 17th October 2025. The matter stands remitted back to the Karnataka State Administrative Tribunal, Bengaluru for - 4 - HC-KAR CNR: KAHC010745382025 NC: 2026:KHC:46553-DB WP No. 34828 of 2025 re-consideration of the matter on merits.
