Mr. Aditya Sen ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.), 1st Court at Asansol to dispose of the Title Suit No.217 of 2021 expeditiously. From the order sheets appended to this application this Court finds that on repeated occasions the petitioner was directed to take fresh steps. The learned advocate appearing for the petitioner submits that though the petitioner has complied with the directions of the learned trial judge by putting in the requisite but on repeated occasions direction is being passed by the learned trial judge to take steps. It will be open to the petitioner to point out such fact before the learned trial judge and upon being approached the learned trial judge shall consider and proceed in accordance with law. With the above observations, CO 2875 of 2026 stands disposed of. There will be no order as to costs.
