Case No.180 of 2026 under section 64(1) of the BNS, 2023 Mr. Malay Bhattacharya …for the petitioner Mr. Somopriya Chowdhury Mr. Debapratim Guha … for the State Mr. Navanil De Ms. Manami Mukherjee Mr. Shoumilya Mazumder …for the de facto complainant 1. The petitioner is apprehending arrest in connection with Gopalnagar P.S. Case No.180 of 2026 dated March 26, 2026 under section 64(1) BNS. He is seeking anticipatory bail under section 482 BNSS. 2. Heard the respective submissions advanced by learned counsels for the petitioner, the State and the de facto complainant. 3. On perusal of the materials in the case diary produced by the learned counsel for the State, it transpires that the petitioner is alleged to have committed rape upon the victim when she went to her café in the evening. The materials collected in the case diary including the statement of the victim recorded under section 183 BNSS support the case of the prosecution. The victim narrated the incident as she narrated in the written complaint as well as in her statement recorded under section 183 BNSS. Charge-sheet has already been submitted. 4. Considering the gravity of the offences in the case diary, I am not inclined to grant anticipatory bail to the petitioner. 5. The application for anticipatory bail is thus rejected. 6.
