IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH Sr. No.117 CR-6575-2026 (O&M) Date of decision: 02.09.2026 Parsin Kaur ..... Petitioner VERSUS Union of India and others ..... Respondents CORAM: HON’BLE MR. JUSTICE DEEPINDER SINGH NALWA Present: Mr. Upender Prasher, Advocate, for the petitioner. Ms. Bhavana Thakur, Advocate, for respondent No.1 Through video conferencing. ***** DEEPINDER SINGH NALWA, J. (Oral) 1. The present revision petition has been filed against the order dated 14.07.2026 (Annexure P-13) passed by the Railway Claims Tribunal, Chandigarh Bench, Chandigarh. 2. A perusal of the facts of the present case would show that the petitioner-claimant No.1 has filed an application for grant of compensation on account of death of Balkar Singh (husband of the petitioner) before the Railway Claims Tribunal, Chandigarh (hereinafter referred to as the ‘Tribunal’). It transpires that the petitioner-claimants filed an application (Annexure P-2) before the Tribunal for permission to allow the applicants- claimant to lead more evidence by way of examination of witnesses i.e. Parsin Kaur and Maninder Singh (minor). The abovesaid application was considered by the Tribunal vide order dated 14.07.2026 (Annexure P-13). It transpires that on 14.07.2026, the learned counsel appearing on behalf of the petitioner-claimants orally submitted before the Tribunal that he intends to RAMANDEEP SINGH 2026.09.02 16:38 I attest to the accuracy and integrity of this document CR-6575-2026 (O&M) 2 examine one more witness, however, the same was not allowed on the ground that the petitioner-claimants were to adduce the entire evidence on that date. 3. Aggrieved against the order dated 14.07.2026 (Annexure P-13) passed by the Railway Claims Tribunal, Chandigarh Bench, Chandigarh, the petitioner has filed the present revision petition. 4. Learned counsel appearing on behalf of the petitioner-claimants submits that although, the applicant’s evidence is closed, however, the petitioner-Parsin Kaur, wife of deceased-Balkar Singh is a material witness and her evidence is relevant for the purpose of proper adjudication of the claim petition. 5. On the other hand, learned counsel appearing on behalf of respondent No.1 submits that as the case was listed on 14.07.2026 for petitioner-claimants to adduce the entire evidence, as such, there is no infirmity or illegality in the order dated 14.07.2026 (Annexure P-13) passed by the Tribunal. 6. I have heard the learned counsel appearing on behalf of the parties at length and have perused the case file. 7. It is not in dispute that the petitioner, namely, Parsin Kaur, wife of deceased-Balkar Singh was a co-passenger. Taking into consideration the abovesaid fact, it cannot be disputed that Parsin Kaur (petitioner herein) is a material witness and her evidence is relevant for the purpose of proper adjudication of the claim petition. 8. In light of the above, the petitioner-claimant i.e. Parsin Kaur, wife of deceased-Balkar Singh is granted one effective opportunity to be examined as additional witness before the Tribunal on the next date of hearing. In case, the petitioner-claimant fails to appear on the RAMANDEEP SINGH 2026.09.02 16:38 I attest to the accuracy and integrity of this document CR-6575-2026 (O&M) 3 abovementioned date, no further opportunity shall be granted to the petitioner-claimant. 9. Accordingly, the order dated 14.07.2026 (Annexure P-13) passed by the Railway Claims Tribunal, Chandigarh Bench, Chandigarh is set aside to an extent of closure of petitioner-claimants evidence. 10. The present revision petition is disposed of in the abovesaid terms. 11. Pending miscellaneous application(s), if any, also stand(s) disposed of.
