Learned advocate appearing for the petitioner submits that petitioner has been falsely implicated in connection with the instant case. There has been no recovery from the present petitioner and he is in custody because of statement of co- accused.
Learned advocate for the NCB opposes the prayer for bail and submits that there are CDR which connect the present petitioner and there are materials to support that petitioner was the driver of the vehicle who fled away from the spot.
Since there are CDR materials available, I am of the opinion that it would not be fit and proper to release the petitioner on bail as the witness action is about to commence.

Learned Trial Court would give priority to the evidence of the independent witnesses.
Petitioner would renew his prayer for bail after the evidence of the independent witnesses are over.
At this stage, CRM (NDPS) 1823 of 2026 is dismissed.
Report submitted by the NCB be kept with the record.
