Order on Board 28/09/2026
1. The applicant has preferred this third bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with
2 Crime No. 608/2026 registered at Police Station Sarkanda District Bilaspur (C.G.) for the offence punishable under Sections 296, 115(2), 351(3), 118(2) and 3(5) of BNS.
2. Case of the prosecution, in brief, is that on 1.5.2026 at about 10.30 an near RSK Academy, Mahamaya Chowk, Sarkanda, a quarrel allegedly took place between injured Anubhav Soni and the accused persons on account of previous enmity. It is alleged that applicant Raj Pali along with co- accused Rishu Singh Thakur abused the injured and assaulted him with scissors, a stick and fists, causing injuries on his neck and left eye. The injured was thereafter admitted to Pratham Hospital, Sarkanda. Bilaspur, where he received treatment. On the basis of the report lodged by the complainant Ravi Kumar Soni, the present crime came to be registered against the applicant and the co-accused. Hence the bail application.
3. The first bail application filed by the applicant bearing MCRC No. 7209 of 2026 was dismissed by this Court vide order dated 06/08/2026 and his second bail application bearing MCRC No. 7657 of 2026 was disposed of vide order dated 17/08/2026.

consideration. He would further contend that the applicant is in jail since 14/07/2026, the charge-sheet has already been filed and the case is triable by learned Judicial Magistrate, therefore, the applicant be enlarged on regular bail as the applicant’s continued incarceration would serve no further investigative purpose .
5. On the other hand, Mr. Kanwaljeet Saini, learned counsel for the non-applicant/State, would oppose the bail application and submit that the charge-sheet has already been filed before the competent Court. He would further submit that applicant had some personal grudge with the injured on account of which he caused injuries by scissors on the face of the injured as a result of which the injured suffered one lacerated wound and one incised wound on his eye and neck and as per the MLC report, the injuries are grievous in nature. He would also contend that applicant has four previous criminal antecedents out of which two cases are still pending which shows that the applicant is a habitual offender, therefore, the applicant is not entitled to grant of regular bail.
6. I have heard learned counsel for the parties and perused the case diary.
7. Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, and the fact that the first bail application preferred by the applicant was dismissed on merits by this Court vide order dated 06/08/2026 passed in MCRC/7209/2026 and the second
4 bail application preferred by the applicant was disposed of vide
order dated 17/08/2026 and there are two live criminal antecedents of the applicant, and further there is no such law that if a case is triable by the Judicial Magistrate, the accused shall be entitled for grant of bail, this Court is not inclined to grant regular bail to the applicant.
8. Accordingly, this MCRC is hereby dismissed. Sd/-
