Learned advocate appearing for the petitioner submits that there has been alleged recovery of 2225 grams of ganja when the petitioner was intercepted at the Airport.
Learned advocate for the Air Customs Authority opposes the prayer for bail. It has also been informed to this Court that the complaint has already been filed before the jurisdictional court.
Having considered the factual matrix of the case and the quantum of recovery, I am of the opinion that the present case is covered by the judgment of Hon’ble Supreme Court in Barnali Bag Vs. Union of India (Special Leave Petition (Crl.) No.3641 of 2026). As such, the prayer for bail of the petitioner is allowed.
Accordingly, the petitioner, namely, Mr. Chetan
2 Chandrakant Gantandel shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, 8th Court, under NDPS Act, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of 24 Parganas (North) without prior permission of the learned special court. Additionally, the petitioner shall make himself available before the investigating officer of the case or the Principal Commissioner, Airport, Air Customs Authority as and when called for.
Accordingly, CRM(NDPS) 1844 of 2026 is allowed.
