1. Report in the form of an affidavit filed on behalf of the respondent nos.1 to 5 filed in Court be taken on record.
2. None appears for the petitioner.
3. BSF authorities are represented by the learned Additional Solicitor General of India.
4. Petitioner complains that, her husband remains missing on and from October 2, 2007.
5. It appears from the report of the respondent nos.1 to 5 that, the husband of the writ petitioner was a Constable in the Border Security Force (BSF). Husband of the writ petitioner was posted to the 2nd Battalion on June 14, 2007. Husband of the writ petition was proceeded against by the BSF authorities on the allegation of being involved in smuggling activities. Apart from the husband of the writ
2 petitioner, another BSF personnel was also proceeded against on the charge of smuggling. Initially, husband of the writ petition was put under closed arrest. Thereafter, since Constables belonging to different battalion were involved disciplinary proceeding was transferred to the third Battalion where, the husband of the writ petition was placed under open arrest.
6. Report states that, disciplinary proceeding against the husband of the writ petitioner culminated in an order of dismissal from service. Moreover, report discloses that, the BSF authorities lodged a police complaint as against the husband of the writ petitioner since the husband of the writ petitioner was absconding from open arrest.
7. Writ petition is pending since 2007. Before us none appears today for the writ petitioner. The writ petitioner went unrepresented on the previous dates also.
8. In such circumstances, no further order need be passed in this petition of writ of Habeas Corpus.
9. WPA/23163/2007 stands disposed of.
