Learned advocate appearing for the petitioners submits that the petitioners are ladies who have been foisted with the present criminal case.
State has produced the case diary.
I have taken into account the postmortem report. Although a case was registered under Section 103 of the BNS but subsequently charge-sheet was submitted under Section 108 of the BNS. Having considered the same, I am of the opinion that as charge-sheet has been submitted and the petitioners are ladies, the prayer for anticipatory bail be allowed. Accordingly, the prayer for
2 anticipatory bail of the petitioners are allowed.
Accordingly, in the event of arrest, the petitioner no.1, namely, Sharmistha Roy and the petitioner no.2, namely, Joyshree Roy shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As charge-sheet has already been submitted before the jurisdictional court, the order of anticipatory bail will remain inforce for a period of six weeks from date.
Thus, CRM(A) 2879 of 2026 is allowed.
Memo of Evidence submitted by the State be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
