D/L862 01.09.2026 Bpg. Partly Allowed C.R.M. (A) 2878 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Krishnaganj Police Station Case No.372 of 2026 dated 12.08.2026 under Sections 69/115(2)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023; Rana Das & Ors. Versus The State of West Bengal & Anr. Mr. Anindya Ghosh Mrs. Sumita Sarkar. …for the petitioners. Mr. Rajdeep Biswas Mr. Arka Mukherjee. …for the State. Affidavit-of-service filed by the petitioners be kept with the record. Learned advocate appearing for the petitioners submits that the petitioner nos.2 and 3 are the mother and sister of the petitioner no.1. According to the learned advocate, petitioner no.1 has been foisted with the false criminal case after maintaining a relationship for a considerable period of time. Learned advocate for the State opposes the prayer for anticipatory bail and draws the attention of the Court to the statement of the victim under Section 183 of the BNSS. Having considered the overall circumstances, I am of the 2 opinion that so far as the petitioner no.1 is concerned, he is not entitled to get the advantage of anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner no.1, namely, Rana Das is rejected. So far as the petitioner nos.2 and 3 are concerned, their prayer for anticipatory bail is allowed. Accordingly, in the event of arrest, the petitioner no.2, namely, Joytsna Das and the petitioner no.3, namely, Sampa Biswas shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, the petitioner nos. 2 and 3 will make themselves available as when the required by the investigating officer of the case. Thus, CRM(A) 2878 of 2026 is partly allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.) 3
