Mr. Basudeb Patra ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the substituted decree holder praying for a direction upon the learned Civil Judge (Junior Division), Bongaon, 24 Parganas (North) to dispose of the Miscellaneous Case No. 4 of 2017 arising out of Title Execution Case No. 6 of 2003 expeditiously. The learned advocate appearing for the petitioner submits that the Co-ordinate Bench passed an order on 24th November, 2025 in C.O. 3983 of 2025 to dispose of the execution case within a stipulated time frame. He submits that in spite of such direction the title execution case is yet to be disposed of. He draws the attention of the Court to the orders passed in the miscellaneous case in support of his contention that the hearing has already been concluded and 31st August, 2026 is the date fixed for passing orders. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing 2 for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, C.O. 2863 of 2026 stands disposed of by requesting the learned Civil Judge (Junior Division), Bongaon, 24 Parganas (North) to dispose of the Miscellaneous Case No. 4 of 2017 as expeditiously as possible but preferably by the end of the month of November, 2026 without granting any unnecessary adjournments to either of the parties. After disposal of the said miscellaneous case the learned trial judge shall make an endeavour to dispose of the Title Execution Case No. 6 of 2003 keeping in mind the direction passed by the Co- ordinate Bench in C.O. 3983 of 2025. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
