Mr. Sayan Kanjilal. …for the de facto complainant. Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in the instant case. Petitioner is in custody for about 7 months. Charge- sheet has already been submitted before the jurisdictional court. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the medico legal report as well as the statement of the victim under Section 183 of the BNSS. Having considered the tender age of the victim, at this 2 stage, I am not inclined to release the petitioner on bail. Petitioner will renew his prayer for bail after the evidence of the victim is completed. Learned trial court would ensure that within a week from the next date charges are framed and within 45 days thereafter the evidence of the victim is completed. With the aforesaid observations, the prayer for bail of the petitioner in CRM(M)1701 of 2026 is rejected at this stage. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
