The Petitioner has approached this Court for grant of regular bail in connection with S.T. No. 71/2023 arising out of Mosabani P.S. Case No. 37/2022 corresponding to G.R. No. 257/2022, registered for the offence under Section 302/201/34 of I.P.C.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the petitioner is not named in the F.I.R and nothing incriminating article has been recovered from the possession of the petitioner. He further submits that other co-accused, namely, Ramjit Hembram has already been granted bail by this Court in B.A. No. 5476 of 2024 vide order dated 26.07.2024 against whom there was same and similar allegation and the petitioner is languishing in jail custody since 24.07.2022; as such, the petitioner may be enlarged on bail. He lastly submits that the petitioner is ready to abide by every condition as imposed by this Court.

Learned A.P.P opposes the prayer for bail of the Petitioner.
5. Having regard to the aforesaid facts of the case, coupled with the fact that other co-accused, namely, Ramjit Hembram has already been granted bail by this

Court and also the fact that the petitioner is in custody since 24.07.2022; hence, I am inclined to enlarge the Petitioner on bail. Accordingly, the above-named Petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Ghatshila in connection with S.T. No. 71/2023 arising out of Mosabani P.S. Case No. 37/2022 corresponding to G.R. No. 257/2022.

It is made clear that the Petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this Petitioner, learned trial court shall be at liberty to cancel the bail of this Petitioner.
