Accused Nos.1 to 4 in Crime No.219/2026 registered by Suryanagar Police Station, Bengaluru District, for the offence punishable under Section 108 of BNS, 2023, are before this Court in this petition filed under Section 482 of the BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.219/2026 was registered by Suryanagar Police Station, Bengaluru District, for the aforesaid offence against the petitioners herein based on the first information dated 10.07.2026 received from Smt.Girija, mother of deceased Kum.Madhusri. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.5360/2026 before the jurisdictional Sessions Court, which was rejected on 25.07.2026. Therefore, they are before this Court. 4. A perusal of the typed first information dated 10.07.2026 received from the mother of the deceased would go to show that her second daughter Madhusri, aged 13 years had committed suicide on 09.07.2026. In the first information, it is - 4 - HC-KAR CNR: KAHC010529362026 NC: 2026:KHC:46832 CRL.P No. 11566 of 2026 alleged that after the dead body of the deceased was cremated, the elder daughter of the first informant had informed her that Madhusri was ill-treated physically and mentally in her school by her teachers and cook. It is alleged that Madhusri had left behind a note in her book stating that she was being ill-treated by teachers and other staff in the school. It is under these circumstances FIR was registered against the petitioners, who are working as teachers and cook in the school, in which the deceased was studying. 5. The petitioners herein are all married ladies and they do not have any criminal antecedents. They have undertaken to co-operate with the police for the purpose of investigation. There is no averment in the first information with regard to any act committed by the accused persons immediately prior to deceased committing suicide which would have abetted or instigated the deceased to take the drastic step of committing suicide. 6. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by accused Nos.1 to 4 for - 5 - HC-KAR CNR: KAHC010529362026 NC: 2026:KHC:46832 CRL.P No. 11566 of 2026 grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following: ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.219/2026 registered by Suryanagar Police Station, Bengaluru District, for the offence punishable under Section 108 of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and each petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioner shall not tamper with the prosecution witnesses and he shall co-operate with - 6 - HC-KAR CNR: KAHC010529362026 NC: 2026:KHC:46832 CRL.P No. 11566 of 2026 the police for investigation and appear before them whenever called upon. 4.
