Mr. Andolon Sarkar, Adv. …for the respondent The Court: The petitioner has preferred the present petition under Section 29A(4) of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the Arbitral Tribunal for completion of the arbitral proceedings and publication of the arbitral award. Learned Counsel for the petitioner submits that the Sole Arbitrator was appointed by this Court vide order dated 17.05.2023 to adjudicate the disputes between the parties. With the consent of the parties, the mandate was extended by six months till 21.03.2025. Thereafter, vide orders dated 03.03.2025, 10.12.2025 and 18.05.2026, the mandate of the Arbitral 2 Tribunal was extended for a period of eight months, four months and three months respectively. Learned Counsel for the respondent states that he has no objection to the extension of the mandate of the Arbitral Tribunal. This Court notes that though the arbitral proceedings had reached an advanced stage and the matter stood reserved for an award on 21.09.2025, the arbitral award has yet not been pronounced despite extensions granted by this Court vide orders dated 10.12.2025 and 18.05.2026. The mandate of the Arbitral Tribunal has expired and hence the petitioner has preferred the present petition. Considering the advanced stage of the arbitral proceedings and in order to enable culmination of the arbitral process, this Court deems it appropriate to extend the mandate of the Arbitral Tribunal for a further period of three months from today. The learned Arbitrator is requested to conclude the proceedings and publish the award within the time period stipulated hereinabove. It is observed that, in the event the learned Arbitrator is unable to publish the award within the extended period, this Court may consider such steps as may be warranted in accordance with law. With the aforesaid observations, the present petition stands disposed of. (GAURANG KANTH, J.) R.Bhar
