Accused Nos.5 and 6 in Crime No.94/2026 registered by Parashurampura Police Station, Chitradurga District, for the offences punishable under Sections 108, 189(2), 191(2), 191(3), 115(2), 118(1), 351(2) and 190 of BNS, 2023, are before this Court in this petition filed under Section 483 of the BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.94/2026 was registered by Parashurampura Police Station, Chitradurga District, against one Ranganatha and 4 others, based on the first information - 3 - HC-KAR CNR: KAHC010525492026 NC: 2026:KHC:46833 CRL.P No. 11527 of 2026 dated 24.06.2026 received from Virupakshamma, wife of deceased Rangaswamy. In the said case, the petitioners herein were arrested on 07.07.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.753/2026 was rejected on 22.07.2026. Therefore, they are before this Court. 4. A perusal of the material on record would go to show that in respect of the alleged incident that had taken place on 23.06.2026 a case and a counter case was registered by Parashurampura Police Station in Crime No.93/2026 and Crime No.94/2026. The deceased - Rangaswamy was arraigned as accused No.1 in Crime No.93/2026 in which Radha, the sister of accused No.1 is the first informant. A reading of the first information submitted in Crime No.93/2026 would go to show that Rangaswamy had illicit relationship with Rangamma (A6) wife of accused No.1 - Ranganatha. After there was a quarrel between the husband of Rangamma and Rangaswamy, Rangamma allegedly had abandoned her husband Ranganatha. It is in this background on 23.06.2026, there was a fight between the family members of Ranganatha and Rangaswamy. - 4 - HC-KAR CNR: KAHC010525492026 NC: 2026:KHC:46833 CRL.P No. 11527 of 2026 5. It is not in dispute that the injured victims in both the cases have suffered only simple injuries as a result of the assault made against each other in the aforesaid incident that had taken place on 23.06.2026. After Rangaswamy had taken treatment in the hospital on 23.06.2026 with regard to the simple injury sustained by him in the aforesaid incident, it appears that he had gone to the house of accused No.6 - Rangamma, who had abandoned her husband Ranganatha (A1) and in the said house, Rangamma (A6) allegedly had abused Rangaswamy and asked him to leave his wife and children and stay with her otherwise to go and die. On the next day, it appears that Rangaswamy had consumed poison and he was admitted to hospital. However, while undergoing treatment, he died in the hospital on 07.07.2026. Thereafter, offence punishable under Section 108 of BNS, 2023 was invoked and accused No.6, whose name is not found in the FIR was also arraigned as an accused in the present case. 6. Considering the reason for which the incident had taken place on 23.06.2026 and the circumstances under which Rangaswamy had consumed poison and committed suicide, I - 5 - HC-KAR CNR: KAHC010525492026 NC: 2026:KHC:46833 CRL.P No. 11527 of 2026 am of the opinion that the prayer made by the petitioners, who are in custody, for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. 7. Accordingly, the following: ORDER The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime Crime No.94/2026 registered by Parashurampura Police Station, Chitradurga District, for the offences punishable under Sections 108, 189(2), 191(2), 191(3), 115(2), 118(1), 351(2) and 190 of BNS, 2023, subject to the following conditions: a) The petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR CNR: KAHC010525492026 NC: 2026:KHC:46833 CRL.P No. 11527 of 2026 d) The petitioners shall not involve in similar offences in future. .
