Choudhury, learned counsel for the petitioner, who submits that by filing this writ petition, the petitioner seeks for a direction to the respondent authorities concerned to pay the petitioner an amount of Rs.12,96,267/-, which is pending in favour of the petitioner for the work undertaken by him. Referring to the liability statement enclosed to the writ petition at Annexure-1, the learned counsel submits that the same is an admitted liability and it has the certification of the responsible officer of the Department concerned i.e. the Water Resources Division, Nagaon. 2. Ms. P. Seyie, learned counsel appearing for the Water Resources Department submits that she may be given some time to obtain instructions in the matter, while Mr. S.R Barua, learned Government Advocate appearing for respondent No.3 and Mr. S. Dutta, learned counsel appearing for respondent No.2 have the same prayer. Page No.# 3/3 3. However, considering the fact that the liability statement which has been prepared by the officials of the Nagaon Water Resources Division, Nagaon and duly certified and recommended by the Additional Chief Engineer, this Court is of the considered view that the writ petition can be disposed of at this stage by directing the respondent authorities to do the necessary verification as to whether such amount is pending in favour of the petitioner as on date or not. 4. Accordingly, the writ petition is disposed of by directing the respondent authorities, more particularly respondent Nos. 4 to 7 to verify the claim of the petitioner for payment of the admitted liability. Upon such verification, if it is found that the amount is due and pending in favour of the petitioner, further necessary steps as may be required be taken for release of the amount to the petitioner without delay. 5. The entire exercise be completed within a period of three months from the date or receipt of a certified copy of this order. 6. Petitioner shall also furnish a copy of the writ petition to the respondent No.4 along with a certified copy of this order for doing the needful. JUDGE Comparing Assistant
