Item No.2 01.09.2026 Court. No. 9 (Saswata) CALCUTTA HIGH COURT IN THE CIRCUIT BENCH AT JALPAIGURI APPELLATE JURISDICTION WPA 1611 of 2026 Suparna Chakraborty Vs. The State of West Bengal & Ors. Mr. Pratip Mukherjee Mr. Sakir Hussain Ms. Swagata Mitra …for the Petitioner Mr. Ashoke Kumar Singhi Ms. Somdutta Patra …for the State Mr. Tara Prasad Halder Mr. Subhasish Misra …for the Siliguri Primary School Council 1. Affidavit of service filed in Court today is retained with the record. 2. The instant writ petition has been filed, inter alia, challenging the memo dated 13th January 2026 whereby the respondents had directed the petitioner to appear before the Chief Medical Officer for medical examination. According to the petitioner, the petitioner had sought for transfer on the ground of medical ailments of her parents and as such, the aforesaid memorandum dated 13th January 2026 calling upon the petitioner to appear before the CMOH for medical examination was based on non application of mind. 3. Learned advocate appearing for the petitioner has, however, candidly submitted that in the interregnum 2 when the petitioner’s previous application for transfer on medical ground was pending consideration before the authorities, the petitioner has already applied for general transfer through the online portal ‘utsashree’ and the petitioner’s application for transfer has already been processed. 4. Let a copy of the application dated 30th July 2026 and the printout of the screenshot from the ‘utsasrhree’ portal which records that the petitioner’s application for transfer has been processed be retained with the record. 5. Having regard to the aforesaid disclosure, I am of the view that since the petitioner has now applied for general transfer on the “utsashree” portal and her application for transfer has been processed by the respondents, no fruitful purpose will be served in keeping the writ petition pending. 6. Accordingly, the writ petition is disposed of. 7. On the prayer of the learned advocate appearing for the petitioner, since the petitioner no longer insists on transfer on medical ground, the memorandum dated 13th January 2026 issued by the Secretary, West Bengal Board of Primary Education, need not be acted upon. 8. All parties shall act on the basis of server copy of this order duly downloaded from this Court’s official website. (RAJA BASU CHOWDHURY, J.)
