Order on Board 29.09.2026
1. The applicant has preferred this First Bail Application under Section 483 the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No.457/2025 registered at Police Station Akaltara, District Janjgir-Champa (C.G.) for the offence under Sections 331(4), 305(a), 112 & 3(5) of BNS, 2023.
2. As per the case of the prosecution, on 15.9.2025, between 1:23 a.m. and 1:25 a.m., the applicant, along with other co-accused persons, NIRMALA RAO
2 entered the ATM of ISAF Bank of the complainant, Sumit Patnaik, and committed lurking house-trespass and house-breaking by using a crowbar, and attempted to steal money. After completion of the investigation, the charge-sheet has been filed.
3. Learned counsel for the applicant would submit that the charge-sheet has already been filed and the applicant has been in jail since 28.11.2025, whereas the conclusion of the trial is likely to take some time. Therefore, the instant bail application may kindly be allowed.
4. On the other hand, learned State counsel opposes the bail application. He would submit that the present applicant entered the ATM of ISAF Bank of the complainant and committed lurking house-trespass and house-breaking by using a crowbar and attempted to steal money and, therefore, the applicant is not entitled to be granted regular bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Having considered the fact that there are three criminal antecedents against the present applicant under Sections 331(4), 305(A), 62, 3, 24(4), 112, 3(5), and 238 of the BNS, and that it is the duty of the Court to take into consideration such criminal antecedents while considering a bail application, I am not inclined to allow this bail application.
7. Accordingly, the bail application of the applicant filed under Section 483 of BNSS, 2023 is rejected. Sd/-
