1. Affidavit of service filed in Court today is retained with the record.
2. The instant writ petition has been filed seeking general transfer on distant ground.
3. The petitioner claims that he has appointed as an Assistant Teacher at Gadhirajote Primary School in the district of Darjeeling. The petitioner seeks transfer as according to him the school where the petitioner is imparting education is about 409 kms away from his residence. The petitioner has two minor children and by reason of the said distances, the petitioner is unable to take care of them as the petitioner resides in a rented accommodation near the school.

Having heard the learned advocates appearing for the respective parties and noting that the petitioner had already applied for transfer in Utasashree portal on 21st July 2026, without going into the issue as to whether the petitioner’s case warrants for transfer, the petitioner’s application should be considered and disposed of in terms of West Bengal Primary Education (Transfer of Teachers including Head teachers) Rules, 2002 (hereinafter referred to as the said Rules) since, the said Rules offer a right to the petitioner to be considered for transfer. In my view the same must be disposed of in a early date.
5. It is expected that the respondents shall dispose of the petitioner’s application for transfer through online mode on an expeditious basis preferably within a period of two months from date.
6. With the above observation, the writ petition is disposed of.
7. There shall be no order as to costs.
8. The parties are to act on the basis of the server copy of this order.
