Applicant has filed this First Bail application under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of anticipatory bail as he has been arrested in connection with Crime No. 193/2026 registered at Police Station – Pithora, District- Mahasamund, (C.G.) for offence punishable under Section115(2), 118(2), 296, 351(3) and 3(5) of BNS,

Case of prosecution in brief is that, the complainant has lodged a report with the concerned Police Station stating that at the time of incident, dispute arose between the parties regarding eating food at Kashibahra Yadav Hotel and thereafter, the accused persons have committed ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2026.09.28 15:08:33 +0530
2 Marpeet with the injured person by using filthy language, as a result of which the injured person has sustained injuries. Based upon the written complaint, the police has registered the offence under Section 115(2), 118(2), 296, 351(3) and 3(5) of BNS, 2023 against the accused persons. Hence, the bail application.

Learned counsel for applicant submits that applicant has been falsely implicated in the crime, he has not committed any offence as alleged. He further submits that applicant is not the aggressor, in fact, the applicant started quarreling. As per allegation, applicant has assaulted the injured only by means of club. There appears to be no pre meditative mind to commit the crime or any pre-planning.Hence the applicant be extended the benefit of anticipatory bail.

Learned counsel for State opposes the submission made by learned counsel for the applicant, however he do not dispute the submission made by learned counsel for the applicant that the applicant is running a hotel where the injured came and at the same time some dispute aroused. He submits that there are six criminal antecedents registered against the applicant.
5. I have heard learned counsel for the parties and perused the documents enclosed along with the bail application.

Taking into consideration the facts and circumstances of the case, nature of allegations, submission made by learned counsel for the respective parties and further considering the manner in which the aforesaid incident took place, without commenting anything on the merits of the case, I am inclined to allow this application for grant of bail.

Accordingly, application is allowed and it is directed that in the event of arrest of applicant in connection with the aforesaid crime, she shall be released on anticipatory bail by the Officer arresting her on executing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned arresting officer. Applicant shall also abide by the following conditions :-
“(i) that the applicant shall remain available for interrogation before the Investigating Officer as and when required; (ii) the applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such
facts to the Court or to any police officer. (iii)that the applicant shall not act, in any manner, which will be prejudicial to fair and expeditious trial; and (iv)that the applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.”
