1. Petitioner has filed this Criminal Miscellaneous Petition seeking following reliefs:
“(a) admit the instant Petition and issue Order(s)/ Direction(s) to call for the entire records relating to the Petitioners' case for its kind perusal. Digitally signed by PRAVEEN KUMAR SINHA Date: 2026.09.28 11:13:50 +0530
-2- (b) direct the Family Court, Durg (C.G.), to decide the application for maintenance under Section 144 of the BNSS, registered as MJC Cri. No. 1102/2025, expeditiously and in a time-bound manner, and in any event within such period as this Hon'ble Court may deem fit to prescribe; (c) direct the Family Court, Durg (C.G.), to decide the application for interim maintenance pending in the said proceedings within sixty days or such period as this Hon'ble Court may deem fit; (d) pass any such other relief(s)/order (s)/direction(s) as this Hon'ble Court may deem just and proper in the facts and circumstances of the case, in the interest of justice.
2. Learned counsel for the petitioner submits that petitioner had filed an application under Section 144 of BNSS before the Family Court, Durg, seeking grant of maintenance along with an application for grant of interim maintenance on 21.08.2025. Case is registered as MJC Cri. No.1102 of 2025 wherein respondent has also caused his appearance on 06.12.2025. However, since then, even after lapse of about more than 8 months, application for grant of interim maintenance is not considered and decided and, therefore, a direction may be issued to concerned Family Court to consider and take decision on interim maintenance application at the earliest within specified time frame.
3. I have heard learned counsel for the petitioner and perused the

4. Considering the submission of learned counsel for the petitioner,
facts and circumstances of the case, this Criminal Miscellaneous Petition is disposed of with a direction to learned Family Court Durg, to consider and decide the interim application for grant of maintenance in accordance with law, expeditiously, preferably within a period of 6 weeks from the date next fixed for hearing.
