JUSTICE ANAND SHARMA Order 16/03/2026 1. Learned counsel for the petitioner submits that earlier S.B. Civil Writ Petition No.12121/2021 was filed by the petitioner before Principal Seat of this Court at Jodhpur, however, the same was dismissed as withdrawn vide order dated 04.09.2021 as the petitioner sought liberty to file a representation before the competent authority to consider candidature of the petitioner in the light of judgment dated 08.01.2020 passed by Division Bench of this Court in D.B. SAW No.908/2017, Namonarayan Sharma Vs. State & Ors. 2. Learned counsel submits that although the petitioner submitted a representation pursuant to order dated 04.09.2021 earlier passed in S.B. Civil Writ Petition No.12121/2021, yet the [2026:RJ-JP:10979] (2 of 2) [CW-4823/2026] same was not decided by the respondents on the pretext that the judgment in the case of Namonarayan Sharma (supra) was challenged by the State of Rajasthan by way of SLP (C) Nos. 13102-13109/2020 (The State of Rajasthan & Ors. Vs. Namonarayan Sharma & Ors.) 3. Learned counsel submits that the aforesaid SLPs were converted into civil appeals and have been disposed of by the Hon'ble Supreme Court vide judgment dated 28.01.2026. 4. Learned counsel for the petitioner submits that the petitioner may be granted liberty to submit a fresh representation in the light of judgment dated 28.01.2026 passed by the Hon'ble Supreme Court in the case of The State of Rajasthan & Ors. Vs. Namonarayan Sharma (supra). 5. In view of the limited prayer made by the learned counsel for the petitioner, this Court deem it just and proper to dispose of this writ petition with liberty to the petitioner to submit a representation to the competent authority which shall be considered and decided by the competent authority by passing a speaking order within a period of sixty days from the date of receipt of representation along with certified copy of this order. 6. It is made clear that this Court has not expressed any opinion on the merits of the case. 7. Pending application(s), if any, shall also stand disposed of. (ANAND SHARMA),J RINCHU /28
