The petitioner herein has preferred this writ petition under Article 226 of the Constitution of India claiming the following reliefs :- “10.1 That, this Hon'ble Court may kindly be pleased to call for records with regards to case of the petitioner, in the interest of justice. 10.2 That, this Hon'ble Court may kindly be pleased to set aside and quash the impugned order dated 10.09.2026, in the interest of justice. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent bank to allow the petitioner to repay the loan amount in monthly basis and one time settlement basis, in the interest of justice. 10.4 That, this Hon'ble Court may kindly be pleased to direct the respondent bank to not take any coercive measures against the petitioner, in the interest of justice. 10.5 That, any other relief in the discretion of this Hon'ble Court. Any other relief, which the Hon'ble Court deems fit and proper under the facts and circumstances, may also be provided to the petitioner.” 2. Learned counsel for the petitioner submits that petitioner has filed this writ petition with a prayer that respondent Bank be directed to consider petitioner’s application and settle his loan account either on one time settlement basis or on monthly installment basis. 3 3. Learned counsel for respondents No. 4 and 5 submits that since petitioner’s prayer is limited, it is open to the Bank to consider and decide the same in accordance with law. 4. Heard learned counsel for the parties and perused the record. 5. Since petitioner has already filed an application for settlement of his loan account on the basis of order dated 17/08/2026 passed by this Court in WPC/4267/2026, the authorities of the respondent Bank are directed to consider the said application within a stipulated period of 30 days and settle the loan account of the petitioner. The respondent Bank authorities are directed to consider and decide petitioner’s application absolutely in accordance with law, by passing a reasoned and speaking order, on merits. It is made clear that this Court has not expressed any opinion on the merits of the matter and it is upon the respondent Bank to consider and decide petitioner’ s application on merits without fail. 6.
