1. The present civil revision petition has been filed by the petitioner under Article 227 of the Constitution of India for setting aside the impugned order dated 12.08.2026 (Annexure P-1) passed in the execution application No.EXE-333-2025 by learned Additional Civil Judge (Senior Division), Talwandi Sabo, Bathinda, whereby the application filed by the petitioner seeking keeping the execution proceedings in abeyance till the decision of his application filed under Order IX Rule 13 read with Section 151 CPC pending adjudication before the Court concerned, has been dismissed.

Learned counsel for the petitioner has apprised this Court that the said application is listed for the appearance of the respondent and the matter is now fixed for 17.09.2026. He further submitted that till the application filed under Order IX Rule 13 for setting aside the ex parte judgment and decree PANKAJ KAKKAR 2026.09.03 17:17 I attest to the accuracy and authenticity of this order/judgment
CR-6622-2026 (O&M) ( 2 ) dated 06.09.2025 (Annexure P-2) is not decided, the proceedings before the Executing Court be stayed as the purpose of filing application under Order IX Rule 13 shall be defeated. He has placed reliance upon judgments passed by this Court in CR-7660-2025 titled Banta Singh Since Deceased Through LR Nishan Singh Versus Diwan Singh and others, decided on 29.10.2025 & in CR-722-2016 titled Davinder Pal Singh and another Versus Narinder Pal Singh and others, decided on 12.04.2016.

In view of the above, the present civil revision petition is disposed of with a direction to the learned Trial Court to expedite the disposal of the application under Order IX Rule 13 preferably within a period of 2 months from receipt copy of this order. It is, however, clarified that till the said application is decided, the execution proceeding pending before learned Executing Court shall be kept in abeyance.
