In Re: Arif Hossain alias Arif Hasan.
… … Petitioner
Mr. Angshuman Chakraborty, Mr. S.S. Saha.
… for the petitioner
Mr. Parmanand Sharma, Mr. Anurag Sardar. …for the State
1. Mr. Chakraborty submits that the present petitioner has been falsely implicated in this case out of personal grudge following a dispute that arose between the parties over a parcel of land. He submits that the petitioner stands on the same footing as the co-accused person who has been granted anticipatory bail. He prays for pre-arrest bail for the present petitioner.
2. Mr. Sharma, learned Advocate appearing for the State, produces the case diary and opposes the prayer for anticipatory bail.
3. Heard the learned Advocates appearing for the respective parties and perused the case diary and other materials. The co-accused person, who is standing on the same footing, has been granted pre- arrest bail, and the incident allegedly occurred in the presence of direct evidence. Taking note of these facts, I am of the view that the privilege under Section 482 of the BNSS can be granted in favour of the petitioner.
4. In view of the above, the prayer for anticipatory bail is allowed.

Arif Hossain alias Arif Hasan be released on bail upon furnishing a bond of Rs. 10,000/-, with two sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Dakshin Dinajpur and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition petitioner shall meet the investigating officer once in a week until submission of charge-sheet.
6. The application for anticipatory bail is, thus, disposed of.
