1. By the present writ petition, the petitioner has prayed for AMARDEEP CHOUBEY Digitally signed by AMARDEEP CHOUBEY Date: 2026.09.28 17:50:37 +0530
2 following reliefs:-
“10.1. That, the Hon'ble Court may kindly be pleased to call for the entire record pertaining to the case of the petitioner.
10.2. That the Hon'ble Court may kindly issue a Writ of Mandamus, or any other appropriate writ, directing the Respondents, to forthwith grant compassionate appointment to the Petitioner against the vacant post of Assistant Revenue Inspector at Municipal Council Amleshwar, or any other suitable equivalent post, pursuant to the Petitioner application dated 21.08.2017 read with the recommendation dated 12.01.2023, within a time frame fixed by this Hon'ble Court.
10.3. Any other relief, which this Hon'ble Court may, deems fit and proper may also be awarded to the petitioner including the cost of the petition.”

Learned counsel for the petitioner submits that father of the petitioner was working as Peon in Municipal Council, Khairagarh and died in harness on 25/07/2017. Thereafter, the petitioner has submitted an application for compassionate appointment along with all related documents. Learned counsel referring to the communication dated 12/01/2023 (Annexure P-6), submits that the Joint Director, Urban Administration and Development, has forwarded the
3 petitioner’s application to the Director, stating therein that no Class-III/IV post is available in the Municipal Council, Khairagarh. However, one post of Assistant Revenue Inspector is lying vacant in the Municipal Council, Amleshwar. Learned counsel further submits that the Joint Director has recommended the appointment of the petitioner against the aforesaid vacant post in the Municipal Council, Amleshwar. He, therefore, submits that the present writ petition may be
disposed of with liberty to the petitioner to approach the Director for consideration and appropriate decision on the recommendation made by the Joint Director vide communication dated 12/01/2023 (Annexure P-6).

Learned counsel for the State submits that if the petitioner approaches the Director, Urban Administration and Development by filing a representation, the same shall be considered keeping in mind the recommendation made by the Joint Director on 12.01.2023, after verifying and examining the candidature of the petitioner for grant of compassionate appointment in lieu of the death of his father, who was working as an employee in Municipal Council, Khairagarh.
4. I have heard learned counsel for the parties, perused the pleadings and documents.
5. Having considered the submissions made by learned counsel for the parties, the writ petition is disposed of with liberty to the
4 petitioner to approach the Director, Urban Administration and Development / respondent No.2 within a period of 15 days by filing a representation. Upon such representation/application being filed by the petitioner, the Director, Urban Administration and Development / respondent No.2 is directed to consider and decide the same in terms of the recommendation made by the Joint Director vide Annexure P-6, within a further period of 60 days.
