This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 1st Court at Uluberia to dispose of the Title Suit No.159 of 2000 expeditiously. Mr. Banerjee, learned advocate appearing for the petitioner draws the attention of the Court to an order dated June 12, 2025 passed in C.O. 1913 of 2025 directing learned trial judge to dispose of the application under Sections 17(2) and Section 17(2A) of the 1956 Act expeditiously. He further submits that pursuant to the said order the aforesaid applications have been disposed of. He submits that the suit is pending from the year
2000. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocate representing the opposite party before the learned trial judge.

From the order sheets appended to this application this Court finds that August 19, 2026 was fixed for hearing of the petitions dated February 19, 2026 and May 11, 2026. In the light of the submissions made by the learned advocate for the petitioner, CO 2811 of 2026 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 1st Court at Uluberia to take up the hearing of the petitions dated February 19, 2026 and May 11, 2026 on the next date fixed and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After regular Presiding Officer joins the learned trial judge shall make an endeavour to dispose of the Title Suit No.159 of 2000 as expeditiously as possible but preferably within a period of one (1) year from the date when the suit is made ready for hearing. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
