Also heard Mr. K K Das, learned Additional Public Prosecutor, Assam. This application has been filed under Section 528 of the BNSS, 2023 in respect of PRC Case No. 1193/2021 pending in the court of the learned SDJM, Hojai, Sankardev Nagar. The petitioner Saif Uddin is one of the accused, who earlier appeared before the trial court. But, Page No.# 2/2 on 2 (two) dates, he did not appear before the trial court without showing any reasons. Therefore, learned trial court issued NBWA against him. The petitioner has shown cause of his absence. Considering entire aspect of the matter, this court is of the opinion that an opportunity should be given to the petitioner to that effect. The learned Additional Public Prosecutor, Assam has objected to this petition. Therefore, the NBWA as well as P&A, issued against the petitioner shall be recalled. Petitioner is directed to appear before the trial court in respect of PRC Case No. 1193/2021 within next 10 (ten) days from today. On his appearance, the trial court shall release him on bail of Rs.10,000/- with one surety of like amount to the satisfaction of the learned SDJM, Hojai, Sankardev Nagar.
