Tulsi Ranjan Das Ms. Sagnika Banerjee …for the Petitioner The present application has been preferred by a 75 years old senior citizen seeking urgent judicial intervention for expeditious disposal of the proceeding being Criminal Misc. Case No. 25 of 2022 under section 12 of the Protection of Violence from Domestic Violence Act, 2005 ( in short (PWDV, Act) presently pending before learned Judicial Magistrate, 1st Court, Baruipur, South 24 Parganas. Being aggrieved by the inordinate delay caused in disposal of the said proceeding learned counsel for the petitioner submits that she initiated the said proceeding in the year 2022 and since then only P.W. 1 has been examined in part. Therefore, she prayed for a necessary direction upon the court below for expeditious disposal of the said proceeding. Petitioner further submits that this Court while disposing of the CRR 2736 of 2023 by an order dated 28.07.2023 directed the court below to fix at least one date in every two months so that the trial can be taken to its logical conclusion within a reasonable period of time. But that order has not been complied with by the Trial Magistrate. 2 Having heard learned counsel for the petitioner and that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with. Having considered the submission made on behalf of the petitioner and that the proceeding under section 12 of the PWDV Act, is pending for more than four years and that such proceeding is to be disposed of within a time bound manner, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of the above, the instant application being CRR 3602 of 2026 is hereby disposed of with a direction upon the court below or Court-in-Charge of the court below to make every endeavour for expeditious disposal of Criminal Misc. Case No. 25 of 2022 presently pending before learned Judicial Magistrate, 1st Court, Baruipur, South 24 Parganas, and to make its best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
