1. This petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed for extension of time to deposit the fine amount of Rs. 3000/- as per order dated 11.06.2024 passed by this Court in CR.R. No. 1207 /2016.

This Court, vide order dated 11.06.2024, while partly allowing the revision petition and sentencing the petitioner to the period already undergone, had enhanced the fine amount of Rs. 500/- to Rs. 3000/- for offence under Section 380 of IPC and had granted one month’s BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN
2 time from the date of passing of the order for depositing the enhanced fine amount.

Learned counsel for petitioner submits that very unfortunately the
order dated 11.06.2024 could not be complied with as petitioner herein remained fail to deposit Rs.3000/- as fine amount before the trial Court because he was not aware about to deposit the fine amount as ordered and as a consequence thereof he has been sent to the jail. He further submits that the petitioner has been sent to the jail on 18.08.2026 for non depositing of Rs.3000/- as a fine amount before the trial Court, whereas the fact remains that he had no knowledge about the final order passed by this Court and the petitioner is still praying for grant of additional time to deposit Rs. 3000/- before the trial Court as a fine amount as the mistake committed by him was not deliberate one. Hence, he prays for last opportunity that the time period for depositing the fine amount may be extended.

Learned counsel for the other side has no objection.
5. From perusal of the record, it transpires that the applicant has failed to deposit the amount of Rs. 3000/- as was ordered by this Court towards the fine amount within a period of one month. Since the applicant failed to deposit the fine amount of Rs.3000/- within the stipulated time, he was taken into custody and is in jail since 18.08.2026.
6. The prayer made by petitioner appears to be reasonable. Hence, the applicant is granted further two weeks’ time from today to deposit enhanced fine amount as was ordered by this Court on 11.06.2024 in Cr.R. No. 1207 of 2016. If the fine amount is deposited within a period
3 of two weeks from today, the applicant be released, if not wanted in any other case.
7. Accordingly, this Cr.M.P. stands disposed of.
