Applicants have preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail as they are apprehending their arrest in connection with Crime No. 41 of 2026 registered at Police Station- Pasta (Chowki - Dawra), District – Balrampur – Ramanujganj (CG) for the offence punishable under Sections 4, 6 & 10 of
2 Chhattisgarh Agriculture Cattle Preservation Act, 2004 and under Section 11 (1) (d) of the Prevention of Cruelty to Animal Act, 1960. 2. The case of the prosecution, in brief, is that complainant has lodged written report in the concerned police station stating that on 10.08.2026 at about 02:00 A.M., the villagers got information that one pick-up vehicle overturned near petrol pump of Village Dawra and in the said vehicle, buffaloes were being transported. Upon receipt of information, they rushed to the spot and found that the pickup vehicle bearing JH 03 Y 7797 was lying and the driver of the said vehicle ran away. Based on the information, police reached the spot and seized four buffaloes and thereafter, crime was registered. 3. Learned counsel for applicant would submit that applicants are innocent, they have been falsely implicated in crime. They have not committed any offence as alleged. He submits that the applicants have been made accused only on the basis of the memorandum statement of the owner of the pickup vehicle. There is no other criminal antecedents against the applicants, hence they may be enlarged on bail. 4. On the other hand, learned counsel for State opposes the submission of learned counsel for the applicants and would submit that the co-accused person who was arrested, had specifically taken the name of these applicants also to be involved in the business of transporting of cattle from Chhattisgarh to Jharkhand. However, she submits that there is no other criminal antecedent mentioned against the applicant in the case-diary.. 3
5. I have heard learned counsel for the parties and perused the documents placed on record. 6.
Taking into consideration the facts and circumstances of the case, nature of allegations, submission of learned counsel for the respective parties and further the fact that the applicants have been named by the co-accused in his memorandum statement, there is no other criminal antecedent against the applicants, without commenting anything on merits of the case, I am inclined to grant anticipatory bail to the applicants. 7. Accordingly, the application is allowed and it is directed that in the event of arrest of applicants in connection with the crime in question, they shall be released on anticipatory bail by the Officer arresting them on their executing a personal bond in the sum of Rs.25,000/- each with one surety in the like sum to the satisfaction of the concerned arresting officer. Applicants shall also abide by the following conditions :- (i) That the applicants shall make themselves available for interrogation before the Investigating Officer as and when required; (ii) The applicants shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such
