This application under Article 227 of the Constitution of India is at the instance of the decree holders praying for a direction upon the learned State Consumer Disputes Redressal Commission, West Bengal, Bench III, to dispose of the Execution Application No. SC/19/EA/79/2018, expeditiously. The learned advocate appearing for the petitioners submits that two interlocutory applications being IA 780 of 2023 and IA 238 of 2025 are still pending. From the order sheets appended to this application, more particularly the order dated 15th July, 2026 it appears that 3rd September, 2026 is fixed for personal appearance of the judgment debtor no.1, namely, Debashis Sarkar and for hearing of the applications being IA 780 of 2023 and IA 238 of 2025. The learned advocate appearing for the petitioners draws the attention of the Court to the decision of the Hon’ble Supreme Court in the case of Periyammal, through Legal representatives & Anr. vs. V. Rajamani & Anr. reported in (2025) 9 SCC 568 and submits that the Hon’ble Supreme Court directed the disposal of the execution case within six months from the date of filing of the same.
2 In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned State Consumer Disputes Redressal Commission, West Bengal, Bench III, to make an endeavour to dispose of the interlocutory applications being IA 780 of 2023 and IA 238 of 2025 along with Execution Application No. SC/19/EA/79/2018 as expeditiously as possible without granting any unnecessary adjournment to either of the parties keeping in mind the direction passed by the Hon’ble Supreme Court in the case of Periyammal (supra). Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisites formalities.
