Kausik (Allowed) CRM (NDPS) 1801 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hili Police Station Case No. 186 of 2025 dated 09.09.2025 under Sections 21(c)/22(c)/23(c)/27A/28 of the NDPS Act and Sectiion 27/27A/27(b)(2) of the Drugs and Cosmetics Act. And In the matter of : Arif Mondal @ Rajib Mondal & Ors. ……Petitioners. Mr. Kaushik Choudhury Mr. Dwaipayan Panda ……for the Petitioners. Mr. Amit Halder Mr. Shivam Mishra ……for the State. Learned advocate appearing for the petitioners submits that the recovery was from another accused namely, Kamal Biswas who has been granted bail in CRM (NDPS) 849 of 2026. State has opposed the prayer for bail but on specific query it has been submitted that there has been no recovery from the present petitioners. However, there are three other cases so far as the present petitioner is concerned. Be that as it may, so far as the present case is concerned, the case is based on statement of co-accused. Having regard to the same, I am inclined to release the petitioners on bail. 2 Accordingly, prayer for bail of the petitioners is allowed. Accordingly, Petitioners, namely, (1) Arif Mondal @ Rajib Mondal, (2) Ujjal Mali, (3) Tanmoy Mondal @ Babin shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1801 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
