And In Re : Pusparani Mondal @ Pushpa Mandal and others ... Petitioners. Mr. Susanta Kumar Mukherjee, Ms. Sonali Bhar ... For the Petitioners. Mr. Anindya Ghosh, Mr. Pronojit Roy ... For the State. Learned advocate appearing for the petitioners submits that petitioners are innocent and have been falsely implicated in connection with the instant case. Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail and produces the case diary. I have taken into account the statement of mother of the deceased recorded under Section 183 of the BNSS. Having regard to the same, I am of the opinion that custodial detention of the present petitioners in connection with the instant case is unwarranted as the accusations are against different person other than the present petitioners. As such, the prayer for anticipatory bail of the petitioners is allowed. Accordingly, in the event of arrest, the petitioners shall be released on bail to the satisfaction of the Arresting Officer 2 on such terms and conditions as he deems fit and proper and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioners shall make themselves available before the Investigating Officer of the case as and when called for by the Investigating Officer of the case. The Investigating Officer of the case at the time of submission of charge-sheet would issue notice to the accused persons so that within a week from submission of charge- sheet, petitioners would take appropriate steps before the jurisdictional court. The application for anticipatory bail, being CRM (A) 2847 of 2026, is, thus, disposed of. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
