The present application has been moved for restoration of FA No. 39 of 2004 which was dismissed on 08.08.2025. 2. Learned counsel for applicant would submit that on account of some unavoidable circumstances, no one could appear before this Court when the matter was taken up for hearing, therefore, FA No. 39 of 2004 was dismissed for want of prosecution. He would submit that the present applicant is interested to pursue the matter. He would pray to restore the appeal to its original number. 3. On the other hand, learned counsel for the State would oppose. 4. Having considered the submissions advanced by Mr. Yadav, the instant MCC for restoration of FA No. 39 of 2004 is hereby allowed. The FA No. 39 of 2004 is restored to its original number subject to payment of cost of Rs. 3000/- payable to Chhattisgarh High Court Legal Services Committee, Bilaspur. 5.
