D/L.04 Rakib (Rejected) CRM (NDPS) 372 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 152/2025 dated 02.02.2025 under Sections 21(C)/27A/29 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of : Sarifa Khatun @ Sarifa Bibi. ……Petitioner. Mr. Arup Kumar Bhowmick ……for the Petitioner. Mr. Ranabir Roy Chowdhury Mr. Anindya Sundar Chatterjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested for alleged recovery of 324 grams of brown sugar and is in custody for one year one month. There is no possibility of the trial commencing in near future as warrant of arrested has been issued against the co-accused which is pending for a considerable period of time. Learned advocate for the State opposes the prayer for bail. Having considered that one of the accused is absconding and the seizure is of commercial quantity of contraband, I direct that the learned trial Court within a period of three months would exhaust the process of law so far as the co-accused who is absconding. Within a fortnight, thereafter the learned trial Court would fix date for consideration of charges. After the charges are over the trial Court would direct for examination of the seizure list witnesses in 2 connection with the instant case and the same be concluded within a month from the date of stage of consideration of charges. Petitioner would be at liberty to approach this Court after the evidence of the seizure list witnesses are over. Accordingly, CRM (NDPS) 372 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
