NATARAJ ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct the respondent No.2 to pass an award in his name concerning the land bearing Sy.No.95/3 measuring 1 acre 44 cents and Sy.No.98/1 measuring 18 cents, in all measuring 1 acre 62 cents of Chelur Village, Ullal Taluk, Dakshina Kannada District, pursuant to an order dated 16.02.2026 passed by respondent No.1 and also by considering the representation dated 01.04.2026. 2. The petitioner submits that the aforesaid land was acquired for the purposes of the Karnataka Industrial Areas - 3 - HC-KAR CNR: KAHC010579322026 NC: 2026:KHC:46292 WP No. 26270 of 2026 Development Board (for short 'KIADB'), for development of an industrial area. The respondent No.1 issued a notice dated 14.10.2025 determining compensation at a sum of Rs.10,00,000/- per acre. The petitioner filed his objections to the said notice. Thereafter, the respondent No.1 issued a notice dated 31.12.2025 and the petitioner has given a representation dated 16.01.2026 to re-determine the compensation. Therefore, by an order dated 16.02.2026, the respondent No.1 passed an award and referred the matter to the respondent No.2 for approval. The petitioner contends that the respondent No.2 has failed to approve the award and therefore, the petitioner was constrained to submit a representation dated 01.04.2026. However, the respondent No.2 has not taken any action till date and therefore, the petitioner seeks for a direction. 3. The learned counsel for the petitioner reiterated above submissions and submitted that the respondent No.2 is bound to approve the award passed by the respondent No.1 and pay the compensation as determined. - 4 - HC-KAR CNR: KAHC010579322026 NC: 2026:KHC:46292 WP No. 26270 of 2026 4. The learned counsel for the respondents submitted that the request of the petitioner would be considered in the light of the award passed by the respondent No.1 and appropriate steps would be taken to approve the award expeditiously in accordance with law. 5. In that view of the matter, this writ petition is disposed of, directing the respondent No.2 to consider the award passed by the respondent No.1 and take appropriate decision to approve it in accordance with law.
