Accused No.1 in Crime No.251/2026 registered by Indiranagar Police Station, Bengaluru for the offences punishable under Sections 85 and 108 of BNS, 2023, pending on the file of X Additional CMM Court, Mayohall, Bengaluru City, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned Additional State Public Prosecutor on behalf of the respondent - State. 3. FIR in Crime No.251/2026 was registered by Indiranagar Police Station, Bengaluru, for the aforesaid offences against the petitioner and others, based on the first information dated 24.07.2026 received from Chandru M, father of deceased, Prerana C, who was the wife of the petitioner. In the said case, petitioner was arrested on 25.07.2026 and subsequently, remanded to judicial custody. His bail application filed before - 3 - HC-KAR CNR: KAHC010588542026 NC: 2026:KHC:47174 CRL.P No. 13121 of 2026 the jurisdictional Sessions Court in Crl.Misc.No.7567/2026 was dismissed. Therefore, he is before this Court. 4. A reading of the first information dated 24.07.2026 submitted by the father of the deceased would go to show that marriage of the deceased with the petitioner was performed on 20.02.2025. In the first information, it is alleged that Prerana, daughter of the first informant was pursuing her studies at the time of her marriage. Petitioner and his parents had assured to continue the studies of Prerana even after marriage. Allegation against the petitioner is that he was suspecting his wife and was in the habit of checking her mobile phone. Prerana had committed suicide on 24.07.2026 by hanging herself in her matrimonial house. There is no such mention in the first information about any such act committed by the petitioner immediately prior to deceased committing suicide which would have either abetted or instigated the deceased to take the drastic step of committing suicide. Petitioner having no other criminal antecedents, is in custody for the last more than one month and other accused persons are said to have been granted bail in the present case. Under the circumstances, I am - 4 - HC-KAR CNR: KAHC010588542026 NC: 2026:KHC:47174 CRL.P No. 13121 of 2026 of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.251/2026 regsitered by the Indiranagar Police Station, Bengaluru, pending on the file of X Additional CMM Court, Mayohall, Bengaluru City, for the offences punishable under Sections 85 and 108 of BNS, 2023 subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR CNR: KAHC010588542026 NC: 2026:KHC:47174 CRL.P No. 13121 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
