It is submitted by the learned advocate for the petitioners that the petitioners have been falsely implicated in this case on the basis of the statement of the co-accused recorded while in custody. Nothing has been recovered from the possession of the present petitioners. 2. Learned advocate for the petitioners further submits that the case of the petitioners stands on similar footing to that of Shyamal Mandal and others who have been granted anticipatory bail by this Court. He prays for anticipatory bail on the ground of parity. 3. Learned advocate for the State opposes the prayer for anticipatory bail. He submits that the petitioners are members of a racket dealing in narcotic contrabands. 4. I have considered the rival contentions of the parties and upon perusal of the materials in the case diary, it transpires that one Amit Mondal was apprehended by the BSF personnel. He was subsequently handed over to the local

police station. He was found in possession of huge quantity of narcotic contrabands. 5. From the materials in the case diary, it transpires that nothing was recovered from the possession of the present petitioners. 6. By order dated August 24, 2026, State was directed to submit a report demonstrating the nexus between the present petitioners and the seized narcotic contraband and/or the person(s) arrested with the narcotic contraband. 7. State has come up with a report dated August 30, 2026. Such report fails to demonstrate any nexus between the petitioners and the seized contraband articles and/or the person(s) arrested with the narcotic contraband. 8. Under such circumstances, the case of the petitioners stands on a similar footing to that of Shyamal Mandal and others who were granted anticipatory bail by this Court on August 19, 2026 in CRM (A) 2621 of 2026. 9.
Considering the aforesaid facts and circumstances, the prayer of the petitioners for grant of anticipatory bail is allowed. 10. Accordingly, I direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a Bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on condition that the petitioners will report before the Investigating Officer once in a fortnight till

the conclusion of the investigation and on condition that the petitioners shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioners in Court including cancelling the anticipatory bail granted without further reference to this Court. 11. C.R.M. (A) 2484 of 2026 is, thus, disposed of. (Md. Shabbar Rashidi, J.)
