This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 37/2026 registered at Police Station : Manpur, District : Mohala-Manpur- Ambagarh Chowki (C.G.) for the offence punishable under Sections 34(2) and 59(A) of Excise Act and Sections 61(2)(A), 111(2-B)(4) and 3(5) of BNS, 2023. The prosecution story in brief is that Police Station Manpur received secret information that certain persons were transporting huge quantity of liquor without any valid license. Acting upon said information, police intercepted and searched a vehicle and seized 7,975.72 bulk litres of English liquor from co-accused Balram Dangi and he was arrested. Name of the present applicant surfaced in the memorandum statement of co-accused persons therefore, he was arrested in connection with the afore-stated offence. 3. Learned counsel for the applicant submits that applicant has falsely been implicated in the present case only on the basis of memorandum statements of the co-accused persons and no incriminating article has been seized from his possession. He further submits that co-accused person from whom seizure was made, namely, Balram Dangi has been granted regular bail by the co-ordinate bench in MCRC/6767/2026. He also submits that charge-sheet has been filed, applicant is in jail since 29.07.2026 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, the learned State counsel opposes the bail application of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Admittedly, FIR was initially registered against Balram Dangi, from whom seizure was made and the present applicant has been implicated on the basis of memorandum statements. However, Balram Dangi has already been granted bail by co-ordinate Bench in MCRC/6767/2026. Also considering the fact that the investigation is complete, charge-sheet has been filed, the applicant is in custody since 29.07.2026 and the trial is likely to take considerable time, without commenting on the merits of the case, this Court is of the considered opinion that it is a fit case to allow the application on the ground of parity. Accordingly, the bail application is allowed. 7. It is directed that in the event of the applicant executing a personal bond for a sum of Rs. 50,000/- to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (a) he shall make himself available for interrogation by the police officer as and when required; (b)he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; and (c) he shall not act in any manner which will be prejudicial to a fair and expeditious trial. 4 The observation made hereinabove is for the purpose of deciding this bail application only, the learned trial Court shall decide the case on its own merits. - Sd/- (Rakesh Mohan Pandey) JUDGE A j i n k y a
