1. The petitioner/defendant has sought for early disposal by the learned trial Court i.e. Civil District Judge, Junior Division, Purulia of the two applications in connection with Title Suit No.645 of 2024, now pending before it. 2. Mr. Dutta, learned advocate appearing for the petitioner/defendant/bank has submitted that an application for injunction under Order 39 Rule 1 and 2 of the Civil Procedure Code is still pending for final disposal by the Court. He submits that in this connection the Court has passed an order of status quo on 19.12.2024, in spite of recording its finding that the plaintiff has taken loan from the defendant/bank against mortgage of his residential house. 3. He has further informed that the defendant/bank has filed an application
2 under Order 7 Rule 11 of the Civil Procedure Code for rejection of plaint, which too is still pending, before the learned trial Court. 4. It is submitted that unless both the applications, as mentioned above, are heard and disposed of by the Court at the earliest, the petitioner/defendant shall suffer irreparable loss and injury. 5. Having considered the prayer of the petitioner as above and perusing the materials on record, this Court is of the opinion that service of this revisional application upon the opposite party in the instant case would not be imperative and service is waived. 6. This revisional application is hereby disposed of, directing the learned trial Court to take up the applications filed by the opposite party/plaintiff, under Order 39 Rule 1 and 2 of the Civil Procedure Code and the application filed by the petitioner/ defendant/ bank under Order 7 Rule 11 of the Civil Procedure Code, for hearing and disposal at the earliest and positively within a period of three months from the date of communication of a copy of this order. 7. Such hearing by the learned trial Court is expected to be done by granting liberty to
3 both the parties to represent themselves and without allowing any unnecessary adjournments to any one of them. 8. Let the learned trial Court be requested to make an endeavour for disposal of the suit, as expeditiously as possible. 9. With the aforesaid directions, this revisional application is disposed of.
