Mr. Ivan Roy ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 2nd Additional Court at Alipore to dispose of the Title Suit No.414 of 2021 expeditiously. The learned advocate appearing for the petitioner submits that issues are yet to be framed in the said suit. He submits that the date for framing of the issues has been fixed sometimes in the month of first week of October, 2026. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2698 of 2026 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Additional Court at Alipore to make an endeavour to frame the issues on the next date fixed and to proceed 2 thereafter in accordance with law. The learned trial judge is requested to make an endeavour to dispose of the Title Suit No.414 of 2021 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
