2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that prima facie offence under Section 109(1) of BNS is not made out against the accused-petitioner. It is also contended that injured Rakesh Meena submitted a compromise before the trial Court in which he has stated that the petitioner’s name was wrongly written and that the complainant does not want to pursue the case qua the petitioner and if the bail application of the accused-petitioner is allowed, then he has no objection. It is further contended that the accused-petitioner is in custody since

Learned Public Prosecutor has vehemently opposed the bail application and contended that the petitioner along with other co- accused caused injuries to injured Rakesh Meena and in the X-ray report, two grievous injuries were found on the leg of the injured. It is further contended that the petitioner is a habitual offender and against him 15 criminal cases pertaining to various offences under IPC such as robbery, theft, etc., have been registered in various Police Stations, therefore, considering the facts of the present case and the conduct of the petitioner, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. In the trial Court, injured Rakesh Meena has submitted a compromise stating that he does not want to pursue the case against the petitioner and if the bail application of the petitioner is allowed, then he has no objection. The injuries sustained by the injured Rakesh Meena were also found to be grievous in nature but not dangerous to life and was not on a vital part, therefore, considering the aforesaid facts and without expressing anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6.
