31.08.2026 Court No.35. D/L.267. Rakib (Rejected) CRM (M) 1633 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Burdwan Police Station case no. 212 of 2024 dated 22.02.2024 under Sections 409/419/420/465/467/468/471/120B/413 of the Indian Penal Code, 1860. And In the matter of : Bhakto Mondal ……Petitioner. Mr. P.K. Bhattacharyya .....for the Petitioner. Mr. Subrata Mukherjee Mr. Sanjib Das ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about a year, other accused persons have been granted bail, charge-sheet has been submitted, as such, petitioner be released on bail. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account the materials appearing in the Case Diary and the complicity of the present petitioner is that petitioner was an employee of Burdwan University who acted as the kingpin for siphoning the funds of the university. Thereafter he absconded for a considerable period of time and was arrested from Bhuj, Gujarat. Having considered the conduct and the complicity of the petitioner, I am not inclined to release the petitioner on bail as he is on a separate footing than the other accused persons. 2 Accordingly, CRM (M) 1633 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
