Learned advocate appearing for the petitioner submits petitioner is in custody for a year and has been implicated because of alleged recovery from the petitioner and another to the tune of 12.9 Kgs. of Ganja from the Airport. Air Customs Authority have opposed the prayer for bail. I have taken into account the fact that complaint has already been submitted before the jurisdictional Court and the petitioners are in custody for a year. 2
Having considered the same and in the light of the judgment of Barnali Bag vs. Union of India (Special Leave Petition (Crl.) No. 3641 of 2026 I am inclined to release the petitioner on bail. As such, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Tanveer Mohd. Irfan Sheikh @ Tanveer Mohd. Irfan Sheikh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 8th Court, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Special Court. Additionally, petitioner shall make himself available as and when called for before the investigating officer or any officer assigned by the Principal Commissioner, Airport, Air Customs Authority. Accordingly, CRM (NDPS) 1805 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
