31.08.2026 IN THE HIGH COURT AT CALCUTTA Item No.790 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 1811 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Hili Police Station Case No. 118 of 2026 dated 26.05.2026 under Sections 21(c)/22(c)/23(c)/27A/28 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Ashim Ghosh ... Petitioner. Mr. Dwaipayan Panda, Mr. Tridip Das ... For the Petitioner. Mr. Somnath Adhikary, Ms. Madhurai Sinha ... For the State. Learned advocate appearing for the petitioner submits that petitioner is innocent. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are three antecedents of the present petitioner being Balurghat P.S. Case No. 435 of 2022, Balurghat P.S. Case No. 524 of 2019 and Balurghat P.S. Case No. 254 of 2019. I find that all the aforesaid cases are under the NDPS Act. Additionally, in the present case there has been seizure in near proximity to the house of the present petitioner (from the backside of the cowshed) and there are also CDRs so far as the present petitioner is concerned. Having considered the conduct of the present petitioner and his previous antecedents, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. 2 Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1811 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
