JUSTICE D K SINGH) The present intra-court appeal is filed impugning the order dated 02.06.2026 passed by the Writ Court in Writ Petition No.34121/2024 (KLR-RES) filed by the appellant herein impugning the Order dated 28.10.2024 passed by the respondent No.2-Tahsildar, Mandya Taluk, Mandya District, for fixing the boundaries in respect of the lands in - 3 - HC-KAR CNR: KAHC010402792026 NC: 2026:KHC:46386-DB WA No. 1601 of 2026 Survey No.42/3 measuring 1.07 acres and the land in Sy.No.43/6, which is the land of respondent No.5. 2. For the sake of convenience, the parties shall be referred to as per their ranking before the Writ Court. 3. In fact, the petitioner himself moved an application before the Joint Director of Land Records to determine the boundaries and the Joint Director on his application passed the order dated 28.10.2024 on his representation dated 18.09.2024. It appears that the petitioner is not happy with the said report of the Joint Director of Land Records. He has filed original suit in O.S.No.798/2024 before the Civil Judge and JMFC at Mandya, seeking the relief of permanent injunction against the respondent No. 5. 4. During the pendency of the writ petition, the Writ Court by its order dated 08.12.2025 directed the Jurisdictional Assistant Director of Land Records, Mandya, to conduct survey and file a report before the Court in - 4 - HC-KAR CNR: KAHC010402792026 NC: 2026:KHC:46386-DB WA No. 1601 of 2026 respect of the subject land concerned. Pursuant to the same, Assistant Director of Land Records had conducted survey on 31.12.2025 and accordingly the report was filed before the Writ Court. That said report was also disputed by the petitioner. Considering the said fact that the petitioner is not accepting the reports prepared on his application, the Writ Court has dismissed the Writ petition as the disputed question of fact cannot be decided. We find no ground to interfere with the impugned judgment and order passed by the Writ Court. Accordingly, the Writ Appeal is dismissed. All pending applications, if any, stand disposed of.
