2. In this writ petition, the petitioner is seeking quashing of the order dated 15.12.2025 at Annexure- A, passed by respondent No. 2 in R.P.No.482 of 2024, and the order dated 20.09.2024, at Annexure-B Passed by the respondent No3 in R.A.(YLK) No.643 of
2023. The petitioner has, inter alia, sought a direction to the respondent-authorities to enter the name of the petitioner in the revenue records.

Learned counsel appearing for the petitioner contended that the petitioner is claiming right over the property on the basis of a Mortgage Deed said to have been executed in favour of Muttamma, from whom the petitioner claims to have derived the right over the property. It is further submitted that the land in question falls within the jurisdiction of the Panchayat

limits and, therefore, the revenue authorities have no authority in law to pass the order of conversion. It is also contended that the land in question has already been converted and, therefore, the revenue authorities have no jurisdiction in respect of the same. 4. Per contra, learned Senior counsel appearing for respondent Nos.5, 7, 10 to 12 invited the attention of this Court to the order dated 07.03.2025 passed in MFA No. 746 of 2025 connected with W.P. No. 19009 of 2023 and contended that the petitioner herein was arrayed as respondent No. 4 in W.P. No. 19009 of 2023. He further invited the attention of this Court to paragraphs 28 and 29 of the aforesaid order and submitted that the petitioner has no legal right, title or interest in respect of the land in question. Therefore, learned Senior Counsel sought for dismissal of the present writ petition. - 7 -

5. Learned High Court Government Pleader appearing for the respondent-State sought to justify the impugned orders passed by the respondent- authorities. 6. In the light of the arguments advanced by the learned counsel appearing for the parties, it is not in dispute that the petitioner is claiming right over the property on the basis of the registered Sale Deeds produced at Annexure B-series. The petitioner claims that the vendor had originally acquired the property through a Mortgage Deed. 7. It is to be noted that the property in question is the subject matter of O.S. No.1068 of
2024. The same property was also the subject matter of K.SC.ST.No.78/2011-12, wherein an order came to be passed by respondent No.4 on 22.12.2014 (Annexure-E1). The order dated 23.06.2023 passed

by the Deputy Commissioner was challenged before this Court in W.P. No. 19009 of 2023.
While disposing of the said writ petition, this Court, at paragraphs 28 and 29, has observed as under:
28. That apart, as held above, the very sale deed executed by Smt. Muttamma in favour of other defendants do not create any right, title or interest over the property to other defendants, as the very defendant No.3 - Smt. Muttamma, herself do not have any right and title over the property, she is only a mortgagee. 29. Such, being the case, no right and title were transferred to the purchaser under the various sale deeds sought for cancellation and are not binding as prayed in prayer B of the suit. Therefore, there is prima-facie case made out by the plaintiffs in their case for the purpose of granting the ad-interim temporary injunction against the defendants. 8. A perusal of paragraph 29 of the aforesaid
order makes it clear that this Court has already recorded a finding that the vendor of the petitioner

had no legal right or title to transfer the land in question in favour of the petitioner.
9. It is also to be noted that the petitioner herein was arrayed as respondent No. 4 in W.P. No. 19009 of 2023. Having suffered the aforesaid order in MFA No. 746 of 2025 connected with W.P. No. 19009 of 2023, the petitioner herein preferred Review Petition Nos. 152 of 2025 and 153 of 2025. This Court, vide order dated 24.07.2025, dismissed the said Review Petitions. Thus, the said order has attained finality.
10. Since the suit in O.S. No. 1068 of 2024 is pending consideration before the learned Trial Court, I am of the opinion that no interference is called for in the present writ petition. The petitioner has to establish his right, title and interest over the land in question in a manner known to law in the said suit.

11. Accordingly, I find no merit in the writ petition and as such the same is dismissed.
12. It is open for the petitioner to approach the competent authority after conclusion of the suit and after establishing his right, title and interest over the property in question in a manner known to law.
Pending application(s), if any, stand disposed of.
